March 14, 2018 at 8:00 PM

New York 11762 for the following purposes:
Case No. 4060 To consider
the variance application
of Mr. Barry Nagelberg,
146 McKinley Street, Massapequa Park, NY 11762 to
maintain a corner rear yard
shed larger and taller than
allowed, rear yard water
falls feature too close to
rear property line, a side
yard stoop and stairs closer
to side property line than
allowed, and a lot coverage
greater than allowed all in
violation of Village Code.
Such proposals are in violation of the following codes;
Chapter 345-43 Sheds which
states: Any shed shall have a
vertical height of not more
than nine (9) ft. Existing
shed stands 9’-10.5” tall. A
shed for the purpose of this
section is defined as a free
standing structure of 120 sq.
ft or less with no permanent
connection to any other
structure. Any structure that
has a permanent connection
of electricity, water drainage or a foundation shall
be considered a permanent
structure not covered by
this section. A permanent
structure requires a building
permit and is subject to the
building code requirements.
Existing structure is 125.6

Chapter 345-31 Rear and
Side Yards which states: In
a Residential “A” District
must maintain a side yard
setback of five (5) ft. Existing
side platform and stoop is
located approximately 2.0 ft.
from east property line.
Chapter 345-31(A) Rear and
Side Yards which states: All
structures require a minimum 15 ft. rear yard setback.
Existing water falls feature is
3’8” ft. from rear property
line.
Chapter 345-28(C) Lot and
Building area which states:
In a residential district the
maximum lot coverage permitted shall be 30%. Existing
lot coverage is 32.25%

Such proposals are in violation of Village Code Chapter 345-43 (A, D) Sheds
which states: A shed for the

with no permanent connection to any other structure.
Any structure that has a

electricity, water, drainage
or a foundation shall be
considered a permanent

six (6) ft. fence and a shed in
second front yard and a shed
on north side of property
all in violation of Village
Code.
Such proposals are in violation of the following codes;
Chapter 345-40(B1) Fences
and Similar Obstructions
which states: On corner
plots, the front side shall be
limited to non opaque, not
solid fences no higher than
48 inches. The street side
(side yard) shall be entitled
to a six (6) ft. opaque (solid)
fence, provided a minimum
13 ft. setback from the property line is maintained. Existing

six (6) ft. solid fence is
installed 16’-1” from south
foundation which is four
(4) ft. closer to property line
than allowed and runs parallel to south property line.
Chapter 345-43 (A,B,C)
Sheds which states: A shed
for the purpose of this section is defined as a free
standing structure of 120 sq.
ft. or less with no permanent
connection to any other
structure. Any structure that
has a permanent connection
of electricity, water, drainage or a foundation shall
be considered a permanent
structure not covered by
this section. A permanent
structure requires a building
permit and is subject to the
building code requirements.
Any shed as defined by this
section shall have a vertical
height of not more than
nine (9) ft. Existing shed has
interior electric for interior
illumination. All sheds shall
be a minimum of two (2) ft.
from rear and either side
of property line. The shed
located on the north side of
property line stands 1’-6”
from north property line.
No shed shall be allowed to
stand in the front setback
of the house on the subject
premises. Existing south
side shed stands in the second front yard 17 inches in
from existing fence line.

Park, NY 11762 to maintain
existing off-street parking
in business areas and offstreet loading retail business
both in violation of Village
Code.
Such proposals are violation
with the following codes;
Chapter 345-35 Off Street
Parking in Business Areas
which states: No use shall
be maintained in the Village unless the following
off-street parking requirements are met. For retail
or personal service shops
or stores you must supply
one (1) parking space per
each 200 square feet of floor
area. Proposed net square
footage in basement is approximately 750.12 sq. ft.,
therefore will require four
(4) new spots.
Chapter 345-36 Off Street
Loading which states: There
shall be provided on the
same lot with any building
or premises hereafter erected or altered or dedicated to

the following uses, space for
off street loading or unloading of vehicles together with
access thereto from a public
street, of sufficient size to
comply with this section.
A single unloading space is
considered to be a space 10
feet wide and 30 feet long or
300 sq. ft. Such space shall
be provided as follows: Retail business buildings with
floor area of over 4,000 sq.
ft. shall provide off street
loading spaces as follows:
one (1) space for each two
(2) employees or 400 sq. ft.
whichever is greater.
Chapter 345-38 Prerequisite
for permit and certificate
of occupancy which states:
No permit or certificate of
occupancy shall be issued
with respect to any building
or premises as to which any
off-street parking facilities
are required by this article
unless such facilities are
provided for in the plans and
constructed accordingly. In
the event that any individual, firm or corporation desires to construct buildings
for the purposes set forth
herein and sufficient land
is not available for parking
facilities, application for a
variance shall be made, and
said Zoning Boar of Appeals
may reduce the off-street
parking requirements which
would otherwise be required
hereunder.

in pursuance of the provisions of the Real Property Tax Law
of the State of New York and of a resolution of the Board
of Trustees of the Inc. Village of Massapequa Park, Nassau
County, New York passed at a meeting thereof held on

To Survey
Residents Regarding
Breakfast Program
The Plainedge School District will be conducting a

survey of parents
and guardians of the students
in kindergarten through
fifth grade, who attend the
Schwarting, East Plain or JH
West Schools, to determine
if there is any interest in a
school breakfast program.
If insufficient interest is determined, an exemption to
participate in the program
